These Terms of Use ("Terms") govern your use of the Helpfl mobile application (the "App"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.
Helpfl is a habit and task tracker that helps you build routines and reduce distraction. You can create recurring habits and one-time tasks, each of which is completed by physically scanning an NFC tag you have set up. You can also choose to block selected apps on your device using Apple's Screen Time (Family Controls) features. When a routine is set to block apps, those apps are shielded at the scheduled time and remain locked until you complete the routine by scanning its tag. Items that do not block any apps act as simple reminders, but still require an NFC scan to be marked complete. The App also includes features such as streaks, Live Activities, and an Apple Watch companion. Features and availability may change over time.
You must be at least 13 years old (or the minimum age required in your country) to use the App, and at least the age of majority in your jurisdiction (or have a parent or guardian's consent) to purchase a subscription. You are responsible for keeping your account credentials secure and for activity that occurs under your account. You can delete your account at any time from Profile → Delete Account in the App.
The App offers an auto-renewing subscription, Helpfl Pro, available on a monthly or yearly basis. The yearly plan may include an introductory free trial.
You agree not to misuse the App, including by reverse-engineering it (except where permitted by law), interfering with its operation, attempting to bypass purchase or security mechanisms, or using it to violate any law or the rights of others.
The App, including its software, design, and trademarks, is owned by Helpfl LLC and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms. No other rights are granted.
You retain ownership of the habits, presets, and other content you create. You grant us a limited license to store and process that content solely to operate the App for you. You are responsible for the content you create.
The App relies on Apple's Family Controls, Managed Settings, Device Activity, and NFC capabilities. These features depend on permissions you grant and on your device's operating system. We do not guarantee that app blocking will be perfect or uninterrupted, and you remain responsible for your own use of your device.
The App is a productivity tool. Do not rely on the App in any situation where a blocked app, missed notification, or delayed access could affect your safety. You can always regain access to your device's core functions, and you are solely responsible for configuring the App appropriately, including for any emergency needs.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. Helpfl is a productivity tool and is not a medical, clinical, or professional service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Helpfl LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP WILL NOT EXCEED THE GREATER OF FIFTY DOLLARS ($50) OR THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
You will indemnify and hold Helpfl LLC harmless from any claims, damages, or expenses arising out of your violation of these Terms or your misuse of the App, except to the extent caused by our own breach of these Terms.
We may suspend or terminate your access if you violate these Terms. You may stop using the App and delete your account at any time. Sections 6 (Your Content), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification), 12 (Apple-Required Terms), and 14 (Governing Law) survive termination.
These Terms are between you and Helpfl LLC, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide support or maintenance for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
We may update these Terms from time to time. The updated version will be posted here with a revised "Last updated" date. Continued use of the App after changes take effect constitutes acceptance.
These Terms are governed by the laws of United States, Alabama, without regard to conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts having jurisdiction over Shelby County, Alabama, and you consent to that venue. Questions? Contact [email protected].
