These Terms of Use ("Terms") govern your use of the Helpfl mobile application (the "App"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.
1. The Service
Helpfl is a habit and task tracker that helps you build routines and reduce distraction. You can create recurring habits and one-time tasks, each of which is completed by physically scanning an NFC tag you have set up. You can also choose to block selected apps on your device using Apple's Screen Time (Family Controls) features. When a routine is set to block apps, those apps are shielded at the scheduled time and remain locked until you complete the routine by scanning its tag. Items that do not block any apps act as simple reminders, but still require an NFC scan to be marked complete. If your tag hasn't arrived yet, you can start one routine without it: for five days it can be completed in the App, and after that it pauses until you register a tag. The App also includes features such as streaks and streak freezes, Time Extenders (which push a lock back a few minutes), an emergency bypass (which unlocks your apps without a scan and resets the streak), Vacation Mode, Live Activities, and an Apple Watch companion. Features and availability may change over time.
2. Eligibility and Accounts
You must be at least 13 years old (or the minimum age required in your country) to use the App, and at least the age of majority in your jurisdiction (or have a parent or guardian's consent) to purchase a subscription. You sign in with Sign in with Apple or Sign in with Google, and you are responsible for keeping that account secure and for activity that occurs under your account. You can delete your account at any time from Me → Delete Account in the App.
3. Subscriptions (Helpfl Pro)
App blocking, NFC tags, streaks, and the App's other core features are free. An auto-renewing subscription, Helpfl Pro, unlocks extra features such as Vacation Mode, advanced scheduling, longer and unlimited Time Extenders, and bonus streak freezes, as described in the App. It is available on a monthly or yearly basis. The yearly plan may include an introductory free trial.
- Price and billing. The price is shown in the App before you purchase. Payment is charged to your Apple Account at confirmation of purchase.
- Auto-renewal. Your subscription automatically renews for the same period unless you cancel it at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends.
- Free trial. If a free trial is offered and you do not cancel before it ends, it automatically converts to a paid subscription. Any unused portion of a free trial is forfeited when you purchase a subscription.
- Managing and cancelling. You can manage or cancel your subscription from Me → Helpfl Pro → Manage in App Store in the App, or in your Apple Account settings. Deleting the App, or your account, does not cancel a subscription.
- Refunds. Purchases are processed by Apple and are subject to Apple's refund policies. We do not directly process refunds.
4. Acceptable Use
You agree not to misuse the App, including by reverse-engineering it (except where permitted by law), interfering with its operation, attempting to bypass purchase or security mechanisms, or using it to violate any law or the rights of others.
5. License to Use the App
The App, including its software, design, and trademarks, is owned by Helpfl, LLC and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms. No other rights are granted.
6. Your Content
You retain ownership of the habits, presets, and other content you create. You grant us a limited license to store and process that content solely to operate the App for you. You are responsible for the content you create.
7. Screen Time and Device Features
The App relies on Apple's Family Controls, Managed Settings, Device Activity, and NFC capabilities. These features depend on permissions you grant and on your device's operating system. We do not guarantee that app blocking will be perfect or uninterrupted, and you remain responsible for your own use of your device. After the App is reinstalled, iOS requires you to choose your blocked apps again before blocking resumes.
NFC tags are sold by third parties, not by us. The App links to tags for sale on Amazon through an affiliate link, and we may earn a commission from purchases made through it.
8. Disclaimers
The App is a productivity tool. Do not rely on the App in any situation where a blocked app, missed notification, or delayed access could affect your safety. You can always regain access to your device's core functions, and you are solely responsible for configuring the App appropriately, including for any emergency needs.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. Helpfl is a productivity tool and is not a medical, clinical, or professional service.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Helpfl, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP WILL NOT EXCEED THE GREATER OF FIFTY DOLLARS ($50) OR THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
10. Indemnification
You will indemnify and hold Helpfl, LLC harmless from any claims, damages, or expenses arising out of your violation of these Terms or your misuse of the App, except to the extent caused by our own breach of these Terms.
11. Termination
We may suspend or terminate your access if you violate these Terms. You may stop using the App and delete your account at any time. Sections 6 (Your Content), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification), 12 (Apple-Required Terms), and 14 (Governing Law) survive termination.
12. Apple-Required Terms
These Terms are between you and Helpfl, LLC, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide support or maintenance for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
13. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted here with a revised "Last updated" date. Continued use of the App after changes take effect constitutes acceptance.
14. Governing Law and Contact
These Terms are governed by the laws of United States, Alabama, without regard to conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts having jurisdiction over Shelby County, Alabama, and you consent to that venue. Questions? Contact [email protected].
